GENERAL
1.1 “Service” or “Services”
in this Agreement means any, some, or all of the following:
(a) home phone services;
(b) business phone services;
(c) long-distance services;
(d) internet services;
(e) any additional telecommunication, internet, or information services and bundle thereof
(f) Pre-authorized agreements (PAD)
(i) An application, client, individual, business, or other forms of legal entity that has subscribed for services is referred to as “you” or “your.” This also includes anybody you authorize to serve as your agent in connection with a service or to use the service through one or more accounts that the internet for USA has designated and delivered to you (collectively referred to as “Account” or “Accounts”).
(ii) “We” or “Us” or “internet for USA ” means internet for USA Communications Inc. or any of its subsidiaries.
1.2 Internet services for the United States are subject to the terms and conditions set out herein, as well as any additional terms and conditions applicable to a specific service, all of which are incorporated into this Agreement. These terms and conditions will take precedence over any other terms and conditions in the case of a conflict. This Agreement, along with any supplementary terms and conditions applicable to a specific service, contains the entire agreement between you and the internet for USA and supersedes any prior written or oral statements or agreements.
1.3 At internet for USA’s discretion, this Agreement may be revised and updated from time to time, and internet for USA will post an updated version on its website at https://internetforusa.com, as well as provide you with notice of such changes via mail, e-mail, or a notification on your monthly bill. Please visit the USA website for the most up-to-date Terms of Service agreement. You will be liable for all charges incurred for use of the services, including any charges resulting from the change or modification, and you will be deemed to have accepted the change if you continue to subscribe to the services.
1.4 You agree to read and comply with internet for USA’s Terms of Use, which can be found at https://internet for USA.ca/terms, and its Privacy Policy, which can be found at https://internet for USA.ca/privacy-policy, and to hold internet for USA harmless from all liabilities and expenses arising from any violation by you of the Terms of Use and/or Privacy Policy, which are incorporated by reference into the Agreement.
1.5 By agreeing to the terms of the Agreement, you permit the internet for USA to receive information about your credit history and agree that the internet for USA may share that information with others to conduct business with you.Language version 1.6. You affirm that you accept this Agreement in English only, as well as all other connected documents, such as invoices and notices.
APPLICATION OF SERVICES
2.1 You may use the services you have subscribed to as long as you comply with this Agreement, including the Terms of Use and Privacy Policy, as well as any applicable laws and
regulations.
2.2 You must also be the age of majority by the legislation of the province or territory of Canada applicable to the Agreement to receive a subscription to a service. By agreeing to the terms of the Agreement, you represent that you have reached the legal age of majority in your jurisdiction.
2.3 You acknowledge that you have the authority to subscribe to the services and that you will not resell or transfer the services to anyone else for any reason, nor will you charge for their usage.
2.4 The internet for USA services and any equipment provided to you are for your normal personal or commercial use only and may not be used in any other way or for any other purpose unless expressly stated so in writing. You agree that if you use the services for commercial or other non-residential purposes, you will be subject to the higher rates that are available for such usage. If the internet for USA determines in its sole discretion that your service is being misused, including without limitation, use for non-residential or commercial purposes and usage exceeding conventional residential use without an express written agreement for that purpose, internet for USA reserves the right to immediately suspend, terminate, or modify the service.
2.5 Except under an official amended version of these Terms of Service, no sales representative, dealer, agent, officer, or employee of the internet for the USA has the power to change or modify these Terms of Service, and you may not rely on any such change or modification.
RESPONSIBILITY FOR CHARGES
3.1 You are solely responsible for all access to, use of, and charges for the services to which you have subscribed, including setup fees, monthly service charges, any restoral fees, long-distance fees, and any other charges incurred in using your Services, regardless of who used them.
NUMBERS AND ADDRESSES FOR TELEPHONE AND OTHER SERVICES
4.1 Ownership: Telephone numbers and other service numbers or addresses (e.g., VOIP, Internet, Static IP addresses, and so on) are restricted public resources. You do not own the phone number(s) assigned to you, and internet for USA reserves the right to modify your phone number(s). internet for USA reserves the right to cancel and/or re-assign a number(s) to correct any technical or human error, as well as for compliance purposes. The internet for the United States will take all possible precautions to avoid such an occurrence.
4.2 Number Portability — You may be able to use an existing telephone or wireless number as your internet for USA Service(s) telephone number, or you may be able to move your internet for USA telephone to another service provider.
(i). Transfer from the internet to USA – If your internet for USA account isn’t in good standing, you won’t be able to transfer your phone number. You will be liable for all fees associated with your service until the transfer is complete.
(ii). Transfer to the internet for USA – internet for USA is not responsible for any termination costs levied by any other service provider as a result of your number being transferred to the internet for USA. The date on which you will be able to switch your number, as well as whether or not you will be able to transfer your number, are not guaranteed or warranted by the internet for USA. Please check the “Warranty Disclaimer and Limitation of Liability” section of these Terms and Conditions for more information. In some circumstances, the internet for USA may provide you with a temporary phone number until you can transfer your number to them.
ADDITIONAL TERMS AND CONDITIONS CONCERNING PARTICULAR SERVICES
5.1 Long Distance
(i). “Unlimited” type pricing plans apply solely to your standard personal and business usage and do not apply to any other usage.
(ii). You agree that the internet for USA may monitor your account for misuse and that if the internet for USA finds, in its sole discretion, that your use is not for traditional household or business purposes, the internet for USA may terminate your plan or immediately move you to another plan.
INTERNET IN THE UNITED STATES FACILITIES AND EQUIPMENT
6.1 internet for USA Equipment: Where necessary, the internet for USA will provide and/or install equipment, such as cables and goods, that is required to provide you with Services. A Refundable Security Deposit at current rates may be required for such equipment.
6.2 Ownership and Interest: You agree that the Equipment, including dial numbers and/or IP addresses issued to you by the internet for USA, will always be the property of the internet for USA, and that you will keep the equipment free and clear of any levies, liens, and encumbrances.
6.3 Equipment not given by internet for USA: If you choose to use equipment not provided by the internet for USA, you acknowledge that internet for USA will not provide support for such equipment and cannot guarantee the equipment’s or service’s functioning.
6.4 Getting Equipment: Unless you notify the internet for USA to the contrary within 5 days of receiving the equipment, the equipment is believed to have been supplied in good functioning condition.
Internet for USA and those acting on its behalf reserve the right to conduct a credit check on you from time to time and to require a deposit or other security, including a credit card payment, before providing or continuing to provide any service to you, and you consent to the credit check and the provision of your personal information to credit bureaus, credit grantors, and suppliers of services by the internet for USA. You also agree to supply any necessary authorizations and financial information that the internet for USA may legitimately seek.
If, in the sole judgment of the internet for USA, you have no credit history with the internet for USA and do not provide adequate credit information, have a poor credit rating, or create a risk of loss, the internet for USA may require security deposits from you. The security deposit will be released at the discretion of the internet for USA and based on acceptable payment history. If you subscribe to more services and/or your service usage rises, further security may be required.
